This case was voluntarily dismissed without prejudice 3/03/2016 due to ordinance’s specific exclusion of airlines.

This Court determined that the co-defendant employers operated as separate companies and therefore lacked the requisite number of employees for application of the ordinance. As a result, this case was dismissed.

The employer previously paid back wages directly to the class members. A settlement for interest on the back wages was reached by the parties and approved by the Court. Due to an arbitration clause which was included in employment agreements, the Court granted defendant’s motion to compel arbitration and dismissed plaintiffs’ court case prior to class certification.
